Webinar Reveals How to Navigate Legal Issues in Current Political Climate

sixNACWA hosted more than 100 participants for the most recent installment of its Hot Topics in Clean Water Law webinar series.  The panel of top clean water law experts led an engaging discussion on topics including the likely approach of the new administration’s EPA to enforcement and regulation, the future of citizen suits, and compliance strategies in the current political climate.

Andrew Stewart, Counsel at Vinson & Elkins LLP, addressed the developments at the Trump Administration EPA and the future of regulations and enforcement.  Mr. Stewart detailed the process EPA must undertake when revising or withdrawing regulations to withstand judicial review.  Additionally, he provided his perspective on what to expect in terms of penalties versus compliance assistance.  Karen Hansen, Principal at Beveridge & Diamond, P.C., presented details on citizen suits along with proactive and preventative strategies for avoiding them.  Ms. Hansen also discussed the likely prevalence of citizen suits under the Clean Water Act given the new administration’s likely approaches to regulations and enforcement.

Nathan Vassar, Associate at Lloyd Gosselink Rochelle & Townsend, presented strategies for compliance during in the current political climate. Rather than taking a wait-and-see approach, Mr. Vassar advised the audience to be mindful of potential state and citizen enforcement and discussed opportunities to implement integrated planning approaches.  The panel of experts concluded with a discussion of the most recent developments concerning new appointments and settlements.
