EPA Proposes Changes to Risk Management Program

EPA has released a pre-publication version of a proposed rule to amend the Risk Management Program (RMP) regulations, with new requirements that could affect clean water utilities.  The RMP proposal includes a requirement to consider inherently safer technologies and justification for not adopting these technologies, which could impact utilities that use chlorine gas disinfection.  The proposal also includes provisions to address climate change and other natural hazards, third-party audits, and community notification.

Comments on the proposed rule are currently scheduled to be due 60 days after publication in the Federal Register.  NACWA will work with other water sector associations to request a comment deadline extension and to develop comments on the proposed rule.  NACWA members that are interested in participating in a workgroup to develop the water sector comments should contact, Cynthia Finley, NACWA’s Director of Regulatory Affairs.
