NACWA Seeking Reviewers for Consent Decree Handbook Revision
After receiving support from the NACWA Board of Directors, NACWA has recently begun the process of updating its document, Wet Weather Consent Decrees: Negotiation Strategies to Maximize Flexibility & Environmental Benefit.
The Handbook is one of NACWA’s most popular resources and has been very helpful to members negotiating enforcement orders, anticipating enforcement actions, considering modifications to existing orders, and implementing decrees. However, the Handbook was last updated in 2016, and many developments have occurred over the last five years that necessitate an update to the Handbook so that it remains a relevant and useful tool for NACWA’s members, especially under a new presidential administration that is likely to take a stronger federal enforcement posture.
NACWA is putting together a review team of public utility members to help guide and provide input on the update process. If you would like to join the review team or have any questions about this initiative, please contact NACWA Chief Legal Counsel Amanda Aspatore.
